Facts:

After 12 years of marriage, the husband filed a complaint for divorce on the grounds of adultery and desertion. The wife filed a cross-bill seeking a divorce on the ground of desertion. Prior to the hearing on the complaints, the parties resolved all issues except for the apportionment of one debt. In closing argument, the husband’s counsel stated that divorce was being sought on the ground of adultery; however, the wife did not pursue her cross-bill based on alleged desertion. Despite the evidence of the wife’s adultery, which included her admission, the trial court exercised its discretion and granted the husband a divorce on a no-fault ground.

The Virginia Court made the following holding:
  • Under Va. Code Ann. § 20-107.3(C), a trial court has the authority to apportion and order the payment of the debts of the parties, or either of them, that are incurred prior to the dissolution of the marriage, based on the factors listed in Va. Code Ann. § 20-107.3(E).
  • Va. Code Ann. § 20-107.1(B) does not require that a divorce be granted on adultery for the spousal support bar to apply. All that is required is that the adultery ground “exists.”
